User Agreement

This user agreement establishes a legally binding contract between you and Fare Republic with regard to the use of this website and the services made available through it. We reserve the right to modify our terms and conditions as per the need of the travel industry. The user is expected to review the modifications time to time to get acquainted with the changes made to our policies and shall abide by the same. The user agrees to have read the policies of our website and understands them thoroughly. Further, he/she (user) agrees to accept all the terms and conditions along with other services offered through us or our affiliates.

1.  Limited User

. The user shall not indulge in any fraudulent activity related to selling, trading or exploiting this website for commercial use or personal use. This website can be used for availing services for personal use only without possessing any harm to this website.

. Fare Republic only acts as the booking agent on behalf of third parties involved in providing various services. In addition, under no circumstances will Fare Republic be liable for any information, software, products, services, or related graphics derived from Fare Republic, whether as a result of a contractual obligation, a claim ( such as negligence), a strict liability agreement, or any other legal theory. Additionally, Fare Republic will not be held liable for any unanticipated suspension of service due to technical issues or for any other reason outside of Fare Republic’s control that may cause the website to be unavailable during routine maintenance operations. The user acknowledges and agrees that they alone are responsible for any harm that results from any material and/or data they download or otherwise obtain from Fare Republic, and that they do so at their own risk and discretion.

Under any circumstances, Fare Republic’s total liability would only be limited to the total amount paid by the customer for using the services, less any applicable cancellation, refund, or other fees, in respect of any services utilized. 4.  Prohibition against Unlawful Activities

The user consents that he will not use this website for any illegal or fraudulent practice under any law, for the time being, in force within or outside India, nor will he indulge in prohibited activities. Furthermore, the website must not be used in any way that could damage, disable, overwhelm, or impair it, as well as interfere with the other party’s use or enjoyment of the website. 5. When you sign up with Fare Republic, we or any of our partners, affiliates, or group companies may contact you from time to time with details about goods or services that may be of interest to you.

6.  Termination/Access Restriction

Fare Republic reserves the right to withdraw access of any user from its website for its services without prior notice in its sole discretion.

7.  Fees Payment

Fare Republic reserves the right to charge listing fees for various services as well as transaction fees for the completed transactions. It can modify the fee structure without prior notice. The user is advised to review the fee structure from time to time to keep him updated with the service fees. The user is responsible for paying all the charges related to the application, fees, duties, taxes, levies and assessments for availing the service of Fare Republic.

8.  User’s obligations and User’s Account

. The user shall confirm to be an adult (18 years old or above) with a sound mind. He should understand the terms of entering into a binding contact and should be a responsible citizen. He should not be barred from availing the services of any enterprise by the legislation of the country.

. The user shall be responsible for keeping the required items (computer, modem, mobile phone, laptop, etc) with him/her for accessing the website to avail services through it. He/she should have access to the World Wide Web to avail the services of Fare Republic. There are other fees also related to the third parties, including the internet charges or the airtime charges which are to be borne by the user for availing the services of these service providers.

. The user agrees to understand the communication messages delivered by the Fare Republic, such as service announcements and administrative messages. The user also agrees that the services are provided as per the nature of the travel industry and Fare Republic does not guarantee or assume the responsibility for any user communication or personalized settings related to omission, wrong delivery or failure.

. We do not mandate the registration of users on our website. It is completely at the sole discretion of the user to choose to register or not to register. If a user registers with us, we provide him with a secured user id and password for availing our services. The user shall be responsible for maintaining the confidentiality of his user id and password and shall take the charge for any misconduct which occurs with the use of such id and password. The user also confirms to not indulge in misrepresentation of the id and password of the third party user which might harm the privacy of other users. You shall undertake the responsibility for guarding the information you are provided with for the use of our website. The password you enter on our website is end to end encrypted and is stored in our database as provided without allowing its access to Fare Republic as well. The user also agrees to be the original holder of the credit card and the information supplied by him/her is authentic and reliable for making the transactions with Fare Republic. The user is the sole bearer of any misconduct relating to the use of id/password/credit card number/accounting details for the financial loss or inconvenience of using our services.

. It is the responsibility of the user to give immediate information to Fare Republic if he/she detects any unauthorized access of his/her id and password. He/she should also log out of their account once they reach the end of the session. Fare Republic will not be liable for any losses or damages incurred by the user if he/she does not comply with these requirements for keeping their data secure.

. The user also agrees to provide the complete details on our website at the time of registration which should be authentic and true about them.

. The user shall be responsible for updating the registration details provided on our website to maintain its accuracy and reliability. If Fare Republic suspects the data shared on our website, it reserves the right to terminate or suspend the access of the user with immediate effect for current as well as future use of our website.

. The user also allows Fare Republic to disclose their details as deemed necessary with third parties to make their experience better with our services.

9.  Breach

1. Fare Republic may restrict the user’s activity, delete the user’s listing, alert other users to the user’s actions, immediately suspend or terminate the user’s registration, or refuse to grant the user access to the website, without limiting any other remedies available to Fare Republic under this agreement, or under applicable law, if: (a) the user breaches the agreement, terms of use or the documents it incorporates by reference; (b) the user does not supply the authentic information to Fare Republic; (c) Fare Republic thinks that the user may possess some potential threat to other user’s rights and breach the governing law which may result in Fare Republic’s liability or other users liability on the whole.
2. Fare Republic may reinstate the suspended users at any time at their sole discretion. But the suspended users cannot avail any services of the website until they have been suspended and not reinstated by Fare Republic. Despite the aforementioned, Fare Republic reserves the right to take strict legal action as Fare Republic deems necessary and to recover any unpaid amounts owed by the user to Fare republic or to the service provider if the user violates this agreement, or the documents it incorporates by reference.

10. Copyright

The user shall not share, post or update any content through the website that’s protected by the copyright or associated with the third party without seeking permission from the owner of such content. The copyright content can only be shared after seeking consent from the owner and with the notice issued for the same. The unauthorized access of copyrighted content is illegal and will lead to criminal action against the user and he/she may be liable to compensate for the same.

11. Relationship

Fare Republic and the user of this website shall not deem it to represent a partnership or any other relationship with the use of this website. None of the provisions of this agreement, terms and conditions or rights state or contain any information regarding any relationship and hence implementation of any similar event is subject to escalation against users by the owner of the website. Similarly, no party or authority should act as an agent of the website without prior consent or notice to Fare Republic. However, it should be noted that if by using the website, the user permits Fare Republic and its agents to access third party sites chosen by them or on their behalf in order to retrieve requested information or data, the user shall be deemed to have designated Fare Republic and its agents as their agents for this purpose.

14. Indemnification

You agree to indemnify us against any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your violation of this user agreement, your improper use of our services, or your violation of any law or the rights of a third party. You also agree to hold us harmless (including our affiliates and subsidiaries, as well as our respective officers, directors, employees and agents) from such claim or demand.

15. Severability

If any section, subsection, sentence, clause, phrase, word, provision, or application of this agreement is found to be unlawful, invalid, unenforceable, or unconstitutional for any person or circumstance, such decision shall not affect the validity of any other section, subsection, sentence, clause, phrase, word, provision, or application. Every section, subsection, sentence, clause, phrase, word, provision, and application of this agreement that can function without the offending section, subsection, sentence, clause, phrase, word, provision, or application shall be deemed severable and shall not affect the validity, enforceability, or constitutionality of the remaining portions of the agreement.

16. Termination of Agreement and Services

. This agreement or service could be terminated by users or Fare Republic with or without a cause at any time and can be effective immediately.

. The user agrees that Fare Republic may terminate the user’s id, password or access to this website with immediate effect under certain circumstances without prior notice. The violation of this agreement or the Terms of Use by the user, requests from law enforcement or government agencies, requests from the user, and failure to pay fees due by the user for the services as specified in the applicable terms of use are just a few examples of the grounds for termination.

. Both the user and Fare Republic have the option to end this agreement by giving the other party written notice. The user’s only remedy is to immediately: (a) stop using the website/service; and (b) inform Fare Republic of such a discontinuance. Fare Republic shall not be responsible to the user if the user objects to any terms and conditions of this agreement, any terms of use, or becomes dissatisfied with the service in any way.

. The user’s right to use the website, services, and software shall immediately cease upon termination of the service. There is no obligation on Fare Republic’s part to carry out any outstanding tasks for the user or to forward any unread or unsent messages to the user or any other party in the future. Any information or data the user has saved on the website cannot be retrieved after the user’s registration or the services are terminated, cancelled or suspended.

17. Notices

All notices and communications, including those concerning modifications to the terms and service, termination of the service, etc. must be made in writing and in English. They must be delivered in person or by commercial messenger or courier service, mailed via registered or certified mail (with a return receipt requested), or sent via email or facsimile (with an acknowledgement of receipt). 

18. Governing Law

This agreement and each term of use shall be governed by and made in accordance with the laws of India without reference to conflict of laws principles. Disputes arising in connection with this agreement and each term of use shall be subject to the exclusive jurisdiction of the courts of Delhi.
